Welcome to the ProReports+ App. This policy applies to you and ProReports+ Team the Developer of the App, irrespective of your country of residence or location. This Policy describes our privacy practices in plain language, keeping legal and technical jargon to a minimum to make sure you understand the information we collect, why we collect it, how it is used and your choices regarding your information.

For simplicity, we refer to all of these as our services” in this Privacy Policy. When the word we” is used, it describes the controller of the App and includes the relevant service providers that help us to make the App available to you. When designing the App, we have made sure that no information that directly identifies you is collected. 

 

Some countries including the EU have a broader definition of personal data this policy covers it. In this sense we would need to first of all explore the definition of personal data.

 

What is Personal Data?

"Personal data" means any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. 

 

What are the legal bases of processing personal data?

The legal bases for processing are listed below and at least one of these must apply whenever we process personal data:

  1. Consent: the individual has given clear consent to process personal data for a specific purpose.
  2. Contract: the processing is necessary for a contract or because you have asked us to take specific steps before entering into a contract.
  3. Legal obligation: the processing is necessary for us to comply with the law (not including contractual obligations).
  4. Legitimate interests: the processing is necessary for our legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect your personal data which overrides those legitimate interests.

You have the right to obtain information about whether and which of your personal data is processed by us. In this case, we will also inform you about:

You have a right to erasure if

  • we no longer need your personal data for its original purpose;
  • You withdraw your consent and there is no further legal basis for processing your personal data;
  • you object to the processing of your personal data and - unless it is direct marketing - there are no overriding reasons for further processing;
  • the processing of your personal data is unlawful;
  • the erasure of your personal data is required by law;
  • your personal data was collected as a minor for information society services.

 

  • Right to information

If you have exercised your right to rectification, erasure or restriction of processing, we will inform all recipients of your personal data, of this rectification, erasure of data or restriction of processing.

 

  • Right to data portability

You have a right to receive your personal data processed by us on the basis of consent or for the performance of a contract in a structured, common and machine-readable format and to transfer it to another controller. If technically feasible, you have the right to have us transfer this data directly to another controller.

 

  • Right to object

You have the right to object to the processing of your personal data in case of special reasons. In this case, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing. In case of processing of your personal data for direct marketing purposes, you have the right to object at any time.

 

  • Right of withdrawal

You have the right to revoke any consent given to us at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

 

  • Right to complain to a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with the competent supervisory authority if you believe that the processing of your personal data by us violates the law.

 

Information We Collect

To help you enjoying our App, we collect some basic technical data as you use our services, for example access logs, as well as information from third parties If you want additional info, we go into more detail below.

 

If you contact us the data, you provide will be stored so that your message can be forwarded to the correct contact person. This is done in accordance with our legitimate interest to process your request. Your data provided will not be used for any other purposes, in particular not for advertising.

 

APP installation via the Apple App Store

You can use the Apple service "App Store" a service of Apple Inc, to install our app. As far as we are aware, Apple collects and processes the following data;

 

  • device identifiers,
  • IP addresses,
  • location information,

 

It cannot be excluded that Apple also transmits the information to a server in a third country. We cannot influence which personal data Apple processes with your registration and the provision of downloads in the respective app store and app store software. The responsible party in this respect is solely Apple as the operator of the Apple App Store. 

 

Account registration

When you create your account, it is necessary to log in with your Instagram Account.  When registering via connect functions of Instagram, you agree to the respective terms and conditions of Instagram and also consent to certain data from your respective profile of being transferred to us.

 

Contact us 

If you contact us the data, you provide will be stored so that your message can be answered and forwarded to the correct contact person. Your data provided will not be used for any other purposes, in particular not for advertising.

 

Usage Information

We collect information about your activity on our services, for instance how you use them and how you interact with our services. Further details you can find below.

 

Device information

We collect information from and about the device(s) you use to access our services, including:

  • hardware and software information such as IP address, device ID and type, device-specific and apps settings and characteristics, App crashes, advertising IDs, browser type, version and language, operating system, time zones, identifiers associated with cookies or other technologies that may uniquely identify your device or browser (e.g., IMEI/UDID and MAC address);
  • information on your wireless and mobile network connection, like your service provider and signal strength; information on device sensors such as accelerometers, gyroscopes and compasses.

 

Google Firebase

Our App uses services from Google. Some Google services process personal data from you as an end user. This is necessary for the provision of Google services. You can find out which data is processed and for what purpose in the Google Privacy Policy. Google often uses "instance IDs" which, according to Google's information, are stored until the end customer makes an API call to delete the ID. After that, the data is deleted from the live and backup system 180 days after the call. More information can be found here. These instance IDs are determined, for example, to know which device notifications should be sent to. However, we do not receive any personal data from Google and make no effort to personalise this data afterwards. We only use the data to analyse user behaviour.

 

We do not assume any guarantee for the above-mentioned data from Google and only refer to the information provided. Google is entitled to change or delete this information at any time, to delete or change the URL (link to Google web sites) or to provide the information on another page. 

 

For Firebase Analytics, Google also uses the advertising ID of the mobile device in addition to the "instance ID" described above. You can restrict the use of the advertising ID in the device settings of your mobile device.

 

Google Analytics for Firebase: Google Analytics uses the data to provide analytics and attribution information. The precise information collected can vary by the device and environment. You can find more information via this link: https://support.google.com/firebase/answer/6318039.

Google Analytics retains ID-associated data for 60 days and retains aggregate reporting and campaign data without automatic expiration, unless the Firebase customer changes their retention preference in their Analytics settings or deletes their project. For Analytics for Firebase, Google uses not only the Instance ID” described above, but also the advertising ID of the end device. You can restrict the use of the advertising ID in the device settings of your mobile device. For iOS: Settings > Privacy > Advertising > No ad tracking

 

How We Use Information

The main reason we use your information is to deliver and improve our services. Additionally, we use this info to help keep you safe. Read on for a more detailed explanation of the various reasons we use your information, together with practical examples.

 

  • To provide our services to you,
  • To create and manage our App and provide new features,
  • To improve our services and develop new ones,
  • To conduct research and analysis of users’ behaviour to improve our services and content (for instance, we may decide to change the look and feel or even substantially modify a given feature based on users’ behaviour),
  • To prevent, detect and fight fraud or other illegal or unauthorized activities,
  • To Perform data analysis to better understand and design countermeasures against these activities

Evaluation of other data for statistical purposes

We also collect information on how you use our App and which areas of our App you visit. When you retrieve the information you requested, data is stored on our servers to provide the services or for security purposes. Internet protocol address (IP address), date, time, the page viewed, downloaded files, requesting domain, browser type, type of operating system and addresses from which you have accessed our App, especially from search engines, are recorded. A personal user profile is not created.

 

This information is necessary to improve the App, in particular to analyse the use of our App, to search for and correct errors, and to optimize our services. In addition, an evaluation is carried out for statistical purposes, e.g., to record the number of visitors to our App (traffic).

 

How We Share Information

We use third parties to help us operate and improve our services. These third parties assist us with various tasks, including data hosting and maintenance, analytics, payment for additional content and security operations. 

 

The transmission of your personal information during an order transaction is encrypted using industry standard Secure Socket Layer ("SSL") technology, (SSL encryption version 3). Any credit card information you provide will not be stored by us but will be encrypted and collected directly from our payment service provider via hypertext transfer protocol secure ("https"). 

 

We may disclose your information if reasonably necessary: (i) to comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements; (ii) to assist in the prevention or detection of crime (subject in each case to applicable law); or (iii) to protect the safety of any person.

 

We may also share information: (i) if disclosure would mitigate our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal rights and legal rights of our users, business partners or other interested parties; (iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.

 

With your consent or at your request

We may ask for your consent to share your information with third parties. In any such case, we will make it clear why we want to share the information. This for example includes 

 

We may use and share non-personal information (meaning information that, by itself, does not identify who you are such as device information, general demographics, general behavioural data,), as well as personal information in hashed, non-human readable form, under any of the above circumstances. 

 

Uninstall

You can stop all information collection by an App by uninstalling it using the standard uninstall process for your device. If you uninstall the App from your mobile device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same mobile device, we will be able to re-associate this identifier to your previous transactions and activities.

 

Accountability

In certain countries, including in the European Union, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process information. The data protection authority you can lodge a complaint with notably may be that of your habitual residence, where you work or where we are established.

 

How We Protect Your Information

We work hard to protect you from unauthorized access to or alteration, disclosure or destruction of information. As with all technology companies, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information will always remain secure.

 

We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage and processing practices to update our physical, technical and organizational security measures.

 

We may suspend your use of all or part of the services without notice if we suspect or detect any breach of security. 

 

How Long We Retain Your Information

We keep your personal information only as long as we need it for legitimate business purposes and as permitted by applicable law. To protect the safety and security of our users on and off our services, we implement a safety retention window of three months following account deletion. During this period, account information will be retained although the account will of course not be visible on the services any more.

 

In practice, we delete or anonymise your information upon deletion of your account (following the safety retention window) or after two years of continuous inactivity, unless:

 

  • we must keep it to comply with applicable law;
  • we must keep it to evidence our compliance with applicable law ;
  • there is an outstanding issue, claim or dispute requiring us to keep the relevant information until it is resolved; or
  • the information must be kept for our legitimate business interests, such as fraud prevention and enhancing users’ safety and security. For example, information may need to be kept to prevent a user who was banned for unsafe behaviour or security incidents from opening a new account.
  • Keep in mind that even though our systems are designed to carry out data deletion processes according to the above guidelines, we cannot promise that all data will be deleted within a specific time frame due to technical constraints.

 

Authorisations and Access

We may request access or permission to certain functions from your mobile device, including your media and download folder. For this purpose, your personal data must be stored for the duration of the session. Data that may be collected when using the Services, i.e., IP address, IP location, type and version of the end device used, information on the mobile network used, time zone settings, operating system and platform. 

 

Advertising

Advertisers and third parties also may collect information about your activity on our app, on devices associated with you, and on third-party sites and applications using tracking technologies. Tracking data collected by these advertisers and third parties is used to decide which ads you see both on our app and on third-party sites and applications. You can opt out on the Digital Advertising Alliance (DAA) if you wish not to receive targeted advertising. You may also be able to choose to control targeted advertising on other websites and platforms that you visit. In addition, you may also choose to control targeted advertising you receive within applications by using the settings and controls on your devices.

Below, you can find a list with all third-party advertising networks and their partners, with whom we work to provide you with a personalised advertisement experience within our app. The advertising networks listed below are independent data controllers in respect of your personal data and you can learn more about how each handles your data by accessing their respective privacy notices using the hyperlinks below.

 

In order to provide personalised advertisements to our users, those listed below use device information that include personal and non-personal information, such as advertising (or ad) identifiers, IP address regarding the delivery of advertisements and your interaction with them and/or other tracking technologies to enable and optimise this advertising procedure. Ad identifiers are non-permanent device identifiers such as Apples ID for advertising (IDFA).

 

Revocation of your consent to data processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of the data processing carried out until the revocation remains unaffected by the revocation.

 

Automated decision-making

We do not use automated decision-making or profiling.

You acknowledge, agree and accept that we do not guarantee or warrant the security of any information that you provide to us, and that you transmit such information at your own risk.
